Deposit may be paid by personal check, but all balances due must be paid by cash at time of kitten pickup.

For the remainder of this contract, the word buyer shall represent the person or persons listed above as purchaser, and seller is Maureen and Corey Dupes, Shanook’s Maine Coons.

This agreement is entered into on                                        between Buyer and Seller for their mutual protection and especially for the protection and well-being of the cat and it is mutually understood that failure to comply with any provision of this agreement may detrimentally effect the reputation and business of Shanook’s Maine Coons . For the sum outlined above, seller does hereby transfer to buyer, the cat described above, subject to the following terms and conditions.

1. Seller guarantees this cat free of any contagious diseases or illnesses, internal parasites ,and congenital deformities , subject to the provisions below :

2. Seller makes NO guarantee as to the cats health unless it is examined by a licensed veterinarian, at buyers sole expense, within 72 hours of purchase. Medical problems detected at that time shall be immediately be brought to the attention of the seller. Seller retains the right to a second opinion by sellers veterinarian, if reasonable distance to buyer, or to a veterinarian at an unrelated practice at sellers cost. Seller will authorize buyer to allow buyers veterinarian to initiate treatment.  The portion of the bill incurred by the buyer for the detection and treatment of any illness shall be paid by the seller to the veterinarian (buyer shall not be reimbursed directly). At buyers option the cat may be returned immediately for a full refund of the purchase price if illness is discovered within warrantee period. The TOTAL liability of the seller shall in no case exceed the purchase price of the cat.  After 72 hours NO refund will be issued to the buyer.

3. This cat will be sold accompanied by a medical record outlining vaccinations and treatments administered while in the sellers possession.   Seller highly recommends this cat NOT be de-clawed and further the seller will assume no responsibility for behavioral or medical changes resulting from the procedure. The seller also recommends that this cat NOT  be allowed outdoors at any time and recommend that buyer provide adequate indoor facilities.  Seller also assumes no responsibility for health problems incurred by the cat going outdoors.  Seller further recommends that this cat always be transported in an approved carrier for the cat’s safety.

4. Buyer agrees that this cat  will receive prompt medical care by a licensed veterinarian when the health of the cat is in question, and this cat will be inoculated regularly with an approved upper respiratory combination vaccine. If this cat is found to be neglected or in ill health for an unreasonable period of time  (to be determined by the seller),  and buyer  is unable or unwilling to provide medical attention for the cat, Buyer will surrender cat to the seller unconditionally and with no reimbursement of selling price.

5. If for any reason buyer becomes unable or unwilling to keep the cat and provide the cat with proper food, shelter and medical attention, buyer agrees to return the cat to seller, with no reimbursement or refund to buyer, or to allow seller to assist in placing the cat. Under no circumstances will buyer sell, lease, trade, give away or otherwise transfer the possession or care of this cat any pet store, shelter or pound, research facility or any similar facility, and it will not be abandoned.  Please understand that as breeders we evaluate buyers before selling our cats, to be sure they go to good homes, and if buyer decides to sell this cat in the future, he/she should also be selective as to who they sell to.

6. Buyer understands that this cat/kitten may not be entered into any cat show without breeders permission.  Buyer  also agrees to send seller pictures and/or write once in a while to let seller know how the cat is doing.   ( We especially like pictures ! ) Buyer further agrees to notify the seller in the event the cat is determined to have a congenital disease that may warrant the seller no longer breed the sire and or dam of the cat.

7. Buyer agrees that this cat will not ever be bred, and further to alter the cat by 6 months of age.  Should  buyer not provide written notification from a licensed veterinarian that the same has occurred by that time, buyer immediately becomes liable for breach of contract.  Buyer may at that time either return the cat without reimbursement  or  immediately alter the cat.  The only exception to this condition of sale will be written statements from a licensed veterinarian that the cat,1. Has a health problem which would make the surgery detrimental to its health, or 2. Is not physically mature enough to be altered, in which case purchaser shall alter cat immediately upon the determination of the veterinarian that said cat has recovered from the health problem, or reached the maturity needed for such surgery.  In the case  of  a sale of an unaltered cat already over the age of  6 months, buyer agrees to alter the cat within 30 days of purchase, or the penalty and conditions outlined above will apply.

       *NOTE: Pet Kittens MUST be altered, Seller will NOT provide registration papers until spay/neuter certificate from buyers vet is sent!

8. Seller makes no guarantee as to what the size and or weight of cat may be. Seller can only speculate based on the sizes of the sire and dam.  It should also be known that Maine Coon Cats do not reach full maturity until 3-5 years of age, and that an altered cat will tend to be larger than a breeding cat.

9. Seller agrees to provide the buyer with the registration papers for the cat upon verification of alteration as described in contract provision number 7 (above) and provided all other contract provisions have been followed. Seller agrees to provide such paperwork in a timely manner, and buyer agrees to all terms of this contract without condition.
