DSL Terms and Conditions

SERVICES DEFINED
A) WorldPath Internet Services (WorldPath) will provide you with High-Speed DSL service and connectivity to a customer provided Windows-based PC or Apple Macintosh computer which meets certain equipment requirements; telephone support information; high speed Internet access; single IP connection and installation at customer's location. Technical Support services are accessible via email help or telephone support (toll-free number).

B) No representation, warranty, term, or condition other than as specifically set forth in this agreement shall be binding on WorldPath

CUSTOMER OBLIGATION
A) You agree to these terms and conditions on behalf of yourself and any person(s) who utilizes the service through your computer, or through the DSL circuit installed in your home. You assume responsibility to ensure that all other users understand this agreement and comply with its terms. You will, at your expense, obtain any and all consents, rights and authorizations necessary for the install and use of the service and equipment. Customer/End User is required to have a copy of their operating system software available on site at the time of the installer visit to facilitate the NIC installation should it be required.

B) You may not transfer your subscription or your rights and obligations under this agreement to any other person.

PAYMENT TERMS
A) You agree to pay any installation fee, a monthly recurring charge, and any other applicable fees for the service. The schedule of fees and charges is set forth on the DSL user registration form. Monthly plan rates do not include applicable taxes and regulatory fees.

B) WorldPath reserves the right to change the amount of fees and charges from time to time at its discretion and upon reasonable notice to you. Installation fees and any applicable equipment charges are due along with payment of the first monthly charge prior or at the time of installation. Monthly charges are payable in advance and due on the 1st. of each month. WorldPath will send notification if account becomes delinquent (17 days past due date). Payment of the delinquent amount must be received by the deadline given on this notification (10 days from the date of delinquency) to avoid interruption of service. WorldPath may charge a reasonable service fee for all returned checks and bankcard or charge card charge backs.

C) If you discontinue the service, you agree to pay a $25.00 reconnect fee before service can be restored. This reconnect fee is applicable regardless of previous or current promotional specials.

Customers who subscribe under WorldPath's "6-Month promotion / commitment" will be subject to an early termination fee of $95 and a charge for any promotional discounts if a service is canceled prior to completion of a 6-month service commitment. If you discontinue the service after the initial 6-month service commitment, you agree to pay a $25 reconnection fee before service can be restored. This reconnection fee is applicable regardless of previous or current promotional specials.

D) Loss of service due to non-payment to WorldPath or Union Communications will result in a $25.00 reconnection fee. The fee and any back balance must be paid before service will be restored.

E) You will be responsible for all expenses (including reasonable attorney's fees) incurred by WorldPath in collecting any unpaid amounts due in accordance with this agreement.

ONLINE TRANSACTIONS/SERVICES
A) Through use of the service, you may access certain information, products, and services from persons other than WorldPath, for which there is a charge, including certain on-line services such as America Online and CompuServe. You agree that all such fees or charges for services, products or information are solely your responsibility. You are also advised that you are solely responsible for the security of your credit card information from unwanted or unauthorized charges for Internet based transactions.

B) WorldPath does not endorse or warranty any third-party products, services or content that are distributed or advertised over the service.

CUSTOMER USE
A) You agree not to resell or redistribute access to the service in any manner. The prohibition on resale or redistribution of access includes, but is not limited to, the provision of e-mail, and Internet access. WorldPath reserves the right to disconnect for failure to comply with any portion of this provision.

B) You agree to abide by the policies of the service as they are electronically posted and added to or modified from time to time. You agree not to use the service, including but not limited to the equipment and software provided by WorldPath: for any illegal purpose; to achieve unauthorized access to any computer systems; for unauthorized access or distribution of any software, data, or material protected by copyright, patent or trade secret material; to interfere with the use of the equipment or services by other customers or disrupt the WorldPath network nodes or network services; to harass, threaten, embarrass, or cause distress, unwanted attention or discomfort upon another customer of the service; to post or transmit any unsolicited advertising, promotional materials or other forms of solicitation to other customers; to post or transmit any sexually explicit, hateful, vulgar, threatening, abusive, harassing, defamatory, racially, ethnically or otherwise objectionable material; or to, with respect to electronic mail messages, engage in sender address falsification, unauthorized relaying or spamming (sending of unsolicited, unwanted and/or undesired electronic mail messages).

C) You may not run a server in connection with the WorldPath residential service, nor may you provide network services to others via the WorldPath residential service. The WorldPath residential service includes a personal web space account for publishing personal Web pages. Examples of prohibited uses include, but are not limited to, running servers for mail, http, ftp, irc, and dhcp, and multi-user interactive forums from a computer or server connected in any way to a WorldPath DSL supplied circuit.

SECURITY
A) WorldPath treats private communications on or through its network as strictly confidential and does not access, use, or disclose the contents of private communications, except as requested by a law enforcement agency. WorldPath does not warrant that any data or files sent to or received from outside the network, or communications directed to or received from outside of the network, will not be subject to unauthorized access by others or that other users will not gain access to your home computer. WorldPath has no responsibility and assumes no liability for such acts or occurrences. WorldPath makes no representation or warranty that any software installed on the home computer or which you may download from the Internet, on-line service provider, or other information provider does not contain any damaging or destructive attribute. WorldPath has no responsibility and assumes no liability for such acts or occurrences. If you choose to run applications from your home computer, which permit others to gain access to it, you must take appropriate security measures. Failure to do so may cause immediate termination of your service by WorldPath. WorldPath is not responsible for and assumes no liability for any damages resulting from the use of such applications. WorldPath is not responsible and assumes no liability for damages resulting from others accessing the home computer either from the home or over the service.

B) WorldPath makes no representation or warranty that any software installed on the home computer or which you may download from the Internet, on-line service provider, or other information does not contain any viruses.

C) While WorldPath supplies access to the Internet, it is not the publisher of any information provided by others through the Internet. WorldPath does not review, censor, or monitor and is not in any manner responsible for any programs or content sent or accessed over the Internet or made available by any individual, user, information provider, on-line service or content provider (other than WorldPath)

SUPPORT AND MAINTENANCE
A) During the term of this agreement WorldPath will retain actual ownership of the DSL modem and it's associated software and equipment. This DSL modem also contains firmware and configuration data that has been programmed into the equipment prior to it being installed. WorldPath is responsible for this data and no local modifications to this data are authorized. Any local attempt to erase, modify or re-program this equipment that results in connectivity failure will subject the end user to equipment or service call charges to repair or remedy the situation. WorldPath will provide customer support, which can be accessed by telephone or by electronic mail. Support will be provided for use of the service, associated hardware and software. WorldPath does not provide support for non-supplied hardware or software; except as necessary to troubleshoot and diagnose circuit or Internet access difficulties. Telephone numbers and electronic mail addresses for support services are available both in the form of printed materials and online.

TERMINATION
A) You or WorldPath may terminate this agreement at any time. Any equipment that has been furnished by WorldPath must be surrendered to WorldPath within 10 days of termination or you will be invoiced for it at the prevailing prices for this equipment. Monthly fees will not be refunded either partially or in full and fees for current month will be expected at time of termination.
